Prologue in English
This book is a collection of the author’s writings on reunification and inter-Korean relations. With North Korea’s Kim Jong-Un asserting the claim of “two hostile states,” it has become essential to reassess the existing inter-Korean relationship. In a situation where North Korea, with respect to the inter-Korean relationship, does not pursue reunification but instead declares two Koreas as hostile states, South Korea must reconsider its position. It is now time to consider whether to continue the current discourse on reunification, to acknowledge North Korea’s claim of the two-state relationship, or to explore a third option.
In Chapter 1, the author examines the theory of two states from a new perspective and analyzes inter-Korean relations from a legal standpoint. The existing inter-Korean relationship has undergone two phases: a period of each side’s neglect and denial of the other side, followed by a phase in which each side saw the other side under a dual status as both an exchange partner and an anti-state organization. The current legal framework is based on this dual status. However, with North Korea’s new assertion of the twostate relationship, the underlying assumptions must change, prompting transformation of the existing legal system. The author reflects on what changes are necessary and why such changes are needed. This chapter includes three related articles in this respect.
Chapter 2 explores the future direction that a unified Korea should aim for. The future of inter-Korean relations is reunification; therefore, it is crucial to consider what are the desired characteristics of a unified nation, what ideologies should be pursued, and what legal frameworks need to be examined in various fields.
Chapter 3 looks into the direction of changes in land systems in North Korea after reunification. Given that land is fundamental to the lives of the residents, it is a priority issue that concerns the interests of all Koreans.
Chapter 4 seeks to identify the direction for inter-Korean agreements. Utilizing John Rawls’ concept of overlapping consensus, the author reviews existing inter-Korean agreements while exploring future directions, in order to ascertain whether there is any overlapping consensus among the existing inter-Korean agreements, to examine what has and has not been implemented among existing inter-Korean agreements and the reasons behind them, and to discuss whether these agreements have disappeared or if they still hold relevance today. This inquiry seeks to find future matters for which the two Koreas should reach agreement and methods for such agreement.
The writings included in this book are a collection of the author’s research over recent years, based on articles published in academic journals and presented at seminars. The author’s core objective is the formation of practical inter-Korean relations. The urgent task for the two Koreas is to overcome the current division of Korea and prepare for the future. Healing the wounds inflicted by the ideological conflicts that caused the division and working to overcome present conflicts are common duties of both North and South Koreans, aimed at building a prosperous united country for ourselves and future generations. Research from a legal perspective is necessary to support this effort. While politics establishes the fundamental framework of a nation, laws must elaborate the framework. Laws and politics should complement each other, and laws should not impede politics. Unfortunately, current laws and case precedents in South Korea are constrained by past frameworks, thus stifling discussions about reunification. If laws can appropriately evolve with social changes, it could reduce social turmoil in the new environment of advancing reunification. The author believes this is the direction that legal professionals, especially those interested in North Korea and unification issues, should pursue.
On December 3, 2024, amidst a state of martial law, the author witnessed once again how the politics utilizes the division of Korea. It is now time to overcome division and move toward the future. In view of North Korea’s assertion of two hostile states and South Korea’s state of martial law, it becomes clear that maintaining the existing inter-Korean relations is unrealistic. A fresh perspective on reunification is now required. As situations change and realities evolve, so too must the legal frameworks. The author sought to explore the direction of changes in inter-Korean relations and find practical implementation strategies. In the future, the goal is to conduct more specific research by field, focusing on actual issues through the study of North Korean laws on individual matters or specific areas. The author is currently striving with the belief that the future can be created.
As society changes, science and technology advance, and the climate dramatically alters, legal frameworks must also evolve. New legal systems suitable for the new environment must be created, and the same applies to reunification. While not forgetting the past, it is crucial to find solutions to current conflicts and aspire for a desirable future. This book represents the results of such efforts. It hopes to provide an objective view of the current inter-Korean relations and serve as a stepping stone to move forward into the future. What we need is more debate and more practice.
